New Mexico Guardianship Reforms Provide New Protections

New Mexico has enacted new guardianship and conservatorship law reforms requiring certification and training for guardians and conservators while setting up a standard grievance process for complaints regarding treatment of conservatees and wards under court ordered conservatorships and guardianships respectively.

A further reform in the newly enacted laws bars conservators from requiring conservatees to sign a “waiver of liability” before they are allowed to receive their inheritance or assets from their estate. Conservators were seen to be holding funds hostage without the release.
